The Ruling — June 26, 2026
The United States Supreme Court ruled 6 to 3 to allow the Trump administration to end Temporary Protected Status (TPS) for approximately 350,000 Haitian immigrants and 6,000 Syrian immigrants living legally in the United States. The ruling removes the legal block that had protected TPS holders since a lower court issued a stay earlier this year — meaning enforcement can now proceed immediately.
What TPS Was
Temporary Protected Status is a federal program created by Congress in 1990. Haiti was first granted TPS in 2010 following a devastating earthquake that killed over 100,000 people. Since then, TPS has been renewed repeatedly because returning to Haiti would be unsafe — due to gang violence, political instability, and natural disasters. Today, more than 2,300 people have been killed by gang attacks in Haiti in 2026 alone, and 1.5 million are displaced. Attorneys for the Haitian plaintiffs stated plainly: many people deported will risk violent death.
What It Means for You
Without TPS, you have lost your protection from deportation and will lose your work authorization. However, your options are individual and case-specific. Some TPS holders may have other legal pathways — asylum, family petitions, employer sponsorship, and others. You need to speak with an immigration attorney as soon as possible. Do not wait. Will I be deported immediately?
Not necessarily immediately, but you are now at significantly greater risk. The legal block protecting you has been removed. Mass deportation of all 350,000 is not instant, but ICE can begin detaining Haitian nationals. Do not delay seeking legal guidance.
Can I still work?
Your work authorization through TPS is in question. The USCIS system may still show your status as active for a short period. Your employer will check the official USCIS TPS page for updates. Speak with an attorney about alternative work authorization pathways.
What if I have a pending asylum case?
This ruling does not cancel pending asylum cases. However, losing TPS removes your temporary protection while you wait, which could increase your risk of detention. Contact your legal counsel immediately.
What if my children were born in the U.S.?
Your U.S. citizen children cannot be deported. However, you as a parent may be at risk. It is critical to create a Family Emergency Plan now — who will care for your children if you are detained. We can help you create this plan.
What do I do if ICE comes to my door?
Do not open the door without a warrant signed by a judge. You have the right to remain silent. Do not sign anything without an attorney. Call a lawyer or legal aid organization immediately. Save the number before you need it.
Are there any options left for me?
Yes — for some people. Options vary case by case and include: asylum, family petition, employer sponsorship, cancellation of removal, and others. Most people need to act quickly. Contact a free immigration attorney as soon as possible.
